OVERVIEW:

THE SITE:
Lot 3 is a ±2.115-acre parcel configured as a north-south rectangular pad site fronting SR-70. The lot is part of the recorded final plat of Park Street Commerce Center (Plat Book 8, Pages 91–92, Okeechobee County Public Records) and is governed by a comprehensive Declaration of Covenants, Conditions, Easements, and Restrictions recorded March 15, 2024 (OR File #2024002893, Okeechobee County). The site is situated immediately north of SR-70 and west of NE 14th Avenue, with shared access via the project's internal roadway network.
The lot is classified as Flood Zone X per FEMA Flood Insurance Rate Map Panel 12093C0480C, effective July 16, 2015, indicating minimal flood hazard and no federal flood insurance requirement.
INFRASTRUCTURE & UTILITIES:
All infrastructure for Park Street Commerce Center is being constructed and delivered by the Declarant, Park Street Okeechobee, LLC, at no cost to individual lot purchasers, pursuant to the recorded Master Plan prepared by American Civil Engineering Co. and approved by the City of Okeechobee. Infrastructure being delivered includes:
Internal roadways and right-of-way improvements, to be dedicated to the City of Okeechobee upon completion

Each lot purchaser is responsible only for extending utility connections from the delivered infrastructure to their individual building, at their own expense. All utility extensions must be installed underground. No on-site septic systems are permitted.
ZONING & PERMITTED USES:
Lot 3 is zoned CHV (Heavy Commercial) by the City of Okeechobee, Florida. Permitted uses include but are not limited to quick-service restaurants with drive-thru, retail strip centers, medical and professional office, financial institutions, personal services, and other commercial uses consistent with CHV zoning and the City's Land Development Regulations. Each lot is developed pursuant to an individual site plan subject to City approval and Declarant architectural review.
Note: Per the recorded CC&Rs (Section 5.9(e)), Lot 2 holds an exclusive right for quick-service restaurant uses predominantly selling burgers and/or frozen desserts. This restriction does not apply to Lot 3, which is unrestricted as to food service uses.
GOVERNANCE — PARK STREET PROPERTY OWNERS ASSOCIATION:
All lots within Park Street Commerce Center are subject to mandatory membership in the Park Street Property Owners Association, Inc., a Florida not-for-profit corporation. The Association is responsible for maintenance of all Common Property, the Surface Water Management System, project signage, landscaping within common areas, and enforcement of the Governing Documents. Assessments are allocated by lot square footage. Lot 3's assessment share is approximately 22.28% of total Association expenses. Assessments are collected quarterly in advance. The Declarant currently subsidizes Association operating deficits during the development period.
